Tahawwur Rana no longer in US Federal custody, likely extradited to India

On April 7, the US Supreme Court “denied” Rana's application for extradition for the second time.

Tahawwur Rana, a Canadian national of Pakistani origin, who is sought in India for his involvement in the 2008 Mumbai terrorist attack, is no longer in the custody of the Federal Bureau of Prisons, authorities said April 9.

Rana, 64, is “Not in BOP (Bureau of Prisons) custody as of 04/08/2025” the federal agency said, a day after he was moved out of Metropolitan Detention Center in Los Angeles, where he was lodged for past several years, from where he unsuccessfully fought legal battle to prevent himself from being extradited to India. 

On April 7, the US Supreme Court “denied” Rana's application for extradition for the second time. The nine-judge bench of the US Supreme Court rejected his application following a conference on this issue on April 4.

The Federal Bureau of Prisons said he was no longer in its custody as of April 8, indicating that he might have been handed over to Indian authorities for extradition. “On April 7, 2025, the U.S. Supreme Court denied Rana’s petition for the stay of his extradition. We have no further details to disclose at this time,” a State Department spokesperson told 5WH. 

“The Secretary of State signed the surrender warrant authorizing Rana’s extradition to Indian authorities on February 11, 2025. Rana’s legal counsel subsequently filed an emergency stay motion seeking to challenge that order,”  said the official.

Rana’s application, originally filed on February 27, was denied by Supreme Court Justice Elena Kagan on March 6. The same day, Rana filed the same application urging that it be submitted to the Chief Justice for reconsideration. Roberts sent it to the full bench on March 19. A conference on this was held on April 4.

During Prime Minister Narendra Modi's visit to the US, President Donald Trump announced that he has approved the long-awaited extradition of Rana. Secretary of State Marco Rubio communicated the same to the US Supreme Court.
