American techie sues TCS for favouring Indians

Devorin alleges that TCS demonstrates bias against older American employees while favoring H-1B visa-holding workers

Randy Devorin, a 61-year-old US citizen with more than ten years of experience at Tata Consultancy Services (TCS) in the global consulting practice, has initiated legal proceedings against the technology giant, accusing it of discriminatory employment practices.

In a lawsuit brought before a US court, Devorin alleges that TCS demonstrates bias against older American employees while favoring H-1B visa-holding workers of Indian or South Asian descent and "freshers" for termination. He has requested a jury trial to address these claims of discrimination.

As outlined in the complaint, Devorin was notified in July of the dissolution of his team and instructed to apply directly for a consultant position on a project. Despite his consistent efforts, including emails and applications, Devorin's attempts did not advance beyond initial stages. He alleges intentional obstruction by the resource management group. In contrast, a younger Indian colleague quickly secured a role and received multiple offers, none of which were extended to Devorin.

This legal action comes after complaints from at least 22 workers filed with the Equal Employment Opportunity Commission (EEOC) since late December, as reported by The Wall Street Journal. These experienced American professionals allege that TCS abruptly terminated their employment and replaced them with workers from India on H-1B visas. 

The lawsuit points out that out of the 14 global managing partners laid off, three Indian global managing partners were rehired into different roles, while the others were not retained.
