The 14th amendment of the United States Constitution says: “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”
Unlike some other areas of the Constitution, this one is unquestionably clear. If you are born on American soil, even to parents who are undocumented or on a work visa like an H-1B, you are a citizen of the United States. The language lays out a tiny number of exceptions — such as for children born to foreign diplomats stationed in the U.S. None of these exceptions, however, undermine the fact that children born to immigrants of any status are conferred U.S. citizenship. Any other argument is completely unfounded.
