India’s EB-5 Unreserved category will move backward to May.1, 2019, according to the U.S. Visa Bulletin for May 2025, dashing expectations for those applying under the EB-5 investor visa category, which has now retrogressed sharply for India.
“High demand and number use by India in the EB-5 unreserved visa categories, combined with increased Rest of World demand and number use, made it necessary to further retrogress the India final action date to hold number use within the maximum allowed under the FY-2025 annual limits,” the bulletin stated,. That offers little comfort for those caught in the backlog.
The bulletin also hinted at the possibility of broader restrictions if demand continues to outpace availability. “Please note that it may also become necessary to establish a final action date for Rest of World countries if demand and number use continues to increase. This situation will be continually monitored, and any necessary adjustments will be made accordingly,” it said.
In the EB-2 category, the cut-off date for Indian applicants is still Jan.1, 2013. All other countries will hold at Jun.22, 2023.
The Department of State issues the Visa Bulletin each month to update applicants on visa cut-off dates, which determine who can file for adjustment of status and who is eligible for permanent residency. Those with a priority date earlier than the listed cut-off can proceed with their application.
