US reaches H-1B visa cap for fiscal year 2025

The United States Citizenship and Immigration Services (USCIS) announced on Dec.2, 2024 that it has received enough petitions to meet the congressionally mandated H-1B visa cap for fiscal year 2025. 

This includes the regular cap of 65,000 visas and the additional 20,000 visas under the US advanced degree exemption, commonly referred to as the master’s cap.

USCIS will notify registrants who were not selected through their online accounts in the coming days. Once these notifications are completed, the status for properly submitted but unselected registrations will reflect as "Not Selected," indicating they are ineligible to file an H-1B cap petition based on this registration.

Despite reaching the cap, USCIS will continue to accept and process petitions exempt from the numerical limitations. These include petitions for current H-1B workers who have previously been counted against the cap and still retain their cap number.

Additionally, the agency will process petitions filed to extend the duration of an H-1B worker's stay in the United States, modify their terms of employment, change employers, or allow concurrent employment in additional H-1B positions.

The H-1B program remains a critical pathway for skilled foreign professionals seeking employment in specialized fields such as technology, engineering, and healthcare. 

This announcement concludes the cap selection process for FY 2025, as USCIS shifts its focus to processing cap-exempt cases and addressing ongoing petitions for current H-1B workers.
