U.S. Citizenship and Immigration Services (USCIS) announced on Sep.18, 2024, an automatic extension of Green Card validity to 36 months for lawful permanent residents who file Form I-90, the Application to Replace Permanent Resident Card.

This new policy came into effect on Sep.10, 2024, and applies to individuals seeking to renew their expiring or expired Green Cards.

Previously, Form I-90 receipt notices granted a 24-month extension, but the updated policy now provides a longer 36-month extension from the expiration date of the current Green Card. This extension is aimed at helping applicants experiencing longer processing times by ensuring they have valid proof of lawful permanent resident status while awaiting their renewed cards.

USCIS has also updated the language on Form I-90 receipt notices to reflect this change. Starting on Sep.10, USCIS began issuing amended receipt notices to those with pending I-90 applications, ensuring that these notices can be used alongside an expired Green Card to provide evidence of continued status and employment authorization.

For lawful permanent residents who have lost their Green Cards and need proof of their status while waiting for a replacement, USCIS advises requesting an appointment at a local USCIS Field Office through the USCIS Contact Center.

In such cases, individuals may receive an Alien Documentation, Identification, and Telecommunications (ADIT) stamp after filing Form I-90.

This policy change is expected to ease concerns for Green Card holders by providing more flexibility and reducing the uncertainty caused by processing delays.
