Congressman Raja Krishnamoorthi has joined his colleagues including Hank Johnson, Jan Schakowsky, Adam Schiff, Shri Thanedar, Jerrold Nadler, Dan Goldman, and Barbara Lee, in cosponsoring the Supreme Court Tenure Establishment and Retirement Modernization (TERM) Act.
The legislation proposes term limits of 18 years for each Supreme Court Justice, enabling a president to appoint a new justice every two years. It aims to restore faith and legitimacy in the Supreme Court while preserving the constitutional protections of judicial independence, an official statement noted.
“Faith and trust in the Supreme Court are broken, and this legislation will begin to tackle the partisanship, politicization, and scandal that have plagued the court over the past few years,” Krishnamoorthi said.
“Imposing term limits on justices and allowing each president, regardless of party, to appoint two justices per presidential term, will help ensure one president cannot stack our nation’s highest court for generations. It’s time we restore trust in our judicial system and democratic institutions by passing the TERM Act,” he added.
The TERM Act proposes several measures, including establishing 18-year terms for Supreme Court justices, after which they would assume senior status. Current justices would also transition to senior status based on their length of service.
Regular nominations for new justices would occur in the first and third year after a presidential election. Additionally, if the number of justices in regular service drops below nine, a randomly-appointed senior-status justice would fill in. Importantly, senior justices retired from regular active service would still hold the office of Supreme Court justice, preserving life tenure.
