Rep. Krishnamoorthi hails court decision upholding TikTok divestment law

In a significant ruling, the DC Circuit Court upheld the Protecting Americans From Foreign Adversary Controlled Applications Act, rejecting TikTok's challenge to overturn the bipartisan law. The decision has been lauded as a crucial step in safeguarding national security, with key lawmakers emphasizing its importance.

Rep. Raja Krishnamoorthi, Ranking Member of the Select Committee on TikTok, celebrated the verdict, reiterating the urgent need to sever the app's ties to its Chinese parent company, ByteDance. 

The court’s decision adds further momentum to efforts requiring ByteDance to divest from TikTok, with lawmakers urging swift action to bring the app under American ownership while preserving its availability for millions of users in the United States.

“With today’s opinion, all three branches of government have reached the same conclusion: ByteDance is controlled by the Chinese Communist Party, and TikTok’s ownership by ByteDance is a national security threat that cannot be mitigated through any other means than divestiture,” Krishnamoorthi said. 

“It’s time for ByteDance to accept that the Protecting Americans from Foreign Adversary Controlled Applications Act, which I co-authored, is the law of the land. Every day that TikTok remains under the Chinese Communist Party’s control is a day that our security is at risk,” he added.

The ruling marks a victory for lawmakers who have long argued that ByteDance’s influence poses significant risks to U.S. sovereignty and user data.

Committee chairman John Moolenaar also welcomed the court’s decision, framing it as a triumph for American users and a rebuke to the Chinese Communist Party. He expressed optimism about TikTok’s potential future under American ownership. 

The Protecting Americans From Foreign Adversary Controlled Applications Act garnered overwhelming bipartisan support when it was passed earlier this year.
